PLEASE READ CAREFULLY. This is a legal document that affects your rights.
1. ASSUMPTION OF RISK
I acknowledge that golf simulator activities involve inherent risks, including being struck by clubs or balls, slips, trips, falls, and physical injury. I understand that staff presence, rules, or safety measures do not eliminate these risks. I voluntarily choose to participate and knowingly assume all risks, whether known or unknown.
2. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE)
To the fullest extent permitted by Utah law, I release, waive, and discharge A&Z Partners, LLC DBA Golf to Go Events, and its owners, members, and employees ("Released Parties") from any and all claims, damages, or liability for personal injury, death, or property damage arising from my participation, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES.
3. INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any claims, damages, costs, and expenses (including attorneys’ fees) arising from my participation, my conduct, my failure to follow instructions, or third-party claims related to my participation.
4. RULES, AUTHORITY & IMPAIRMENT
I agree to follow all instructions from Golf to Go Events staff, who have full authority to deny or end my participation for safety reasons. I agree not to participate while impaired by alcohol, drugs, or any substance affecting coordination or judgment. Staff may deny participation if they determine I am impaired or unsafe.
5. MEDICAL ACKNOWLEDGMENT
I certify I am physically able to participate and have no medical condition that would increase my risk of injury. I assume full responsibility for any injuries or conditions arising during participation.
6. MEDIA RELEASE
I grant Golf to Go Events the right to photograph and/or record video of me during participation and use such media for marketing and promotional purposes without compensation. I waive any right to inspect or approve final use.
7. MINORS (IF APPLICABLE)
If the participant is under 18, the undersigned parent or legal guardian agrees to all terms of this waiver on behalf of the minor and accepts full responsibility, including indemnification of the Released Parties from any claims brought by or on behalf of the minor.
8. GENERAL PROVISIONS
If any provision of this waiver is found invalid, the remaining provisions remain in full force. This waiver is governed by the laws of the State of Utah and may be executed electronically.
